I don't know the national or provincial laws in Canada, so can't speak with authority about your situation. In the US if an Individual Education Plan says that a child will get whatever service, the individual classroom teacher does not have the option of refusing to allow it. It is perhaps not reasonable to say that a teacher must learn to sign, but that person can't refuse to allow signing to go on in the classroom.... if I understood you correctly? The classroom teacher should have been part of the team developing the plan in the first place and had the opportunity to express any objections at that time. If the team as a whole overrode those objections, then the activity in question happens. Period. The law is on the side of the student who needs special education services - regular ed teachers do not have the right to refuse. --

Does anyone have more specific information about this guideline? Where I can get a copy? It would be helpful information (read ammunition) to throw on the table at our Annual Reviews.

Hello there...

The DOE Policy Guidance was first issued in 1992 and was sent out again in 1995 when it became obvious that local educational agencies were continuing to ignore the communication and language needs or considerations when placing or designing programs for deaf and hard of hearing students. If you were to send me an email reminder I'll locate, when I get to the office on Monday, the exact Fed. Register information that will help you track it down. In addition to the policy guidance the National Association of State Directors of Special Education has published a book titled: "Deaf and Hard of Hearing Students, Educational Service Guidelines. This book includes the policy guidance as one of its core elements and addresses a host of other issues related to placement and services for this population. This should be in the hands of every parent of a deaf or hard of hearing child, and was written with cooperation from every National level group in the Nation that has a legitimate interest in representing deaf and hard of hearing children and youth (e.g., NAD, AGBELL, CEC, CEASD, CAID, CED, NCSA, etc.).

Both the policy guidance and the NASDSE document have been referred to or used in court decisions so there is a wealth of support there, ready to be tapped. If you have difficulties with the IEP or other aspects of your child's program and believe your school district is not in compliance with the IDEA, there is a lawyer in the NAD Law Center that focuses on these issues. In all likelihood she already has a full load of case work but it might be worth a shot.
